Terms and conditions
These are the ‘terms and conditions’ of the Clear Communication Awards. When you submit your entry, you agree to be bound by these terms. If you don’t comply with these terms, we have the right to disqualify you or declare your entry ineligible.
The Clear Communication Awards can amend the terms and conditions in any way, at any time, before the closing date for the Awards at its absolute discretion. Entrants will be advised of any changes before the closing date.
Entering the awards
Entries must be received by midnight AEST on 31 July 2019.
Submissions will only be considered when submitted through the Clear Communication Awards’ website. Incomplete entries will not be considered.
The same item can be entered into one Industry Category award and one General Category award provided the entry meets the description of that category. An entry fee applies for each Category entered.
The Clear Communication Awards can transfer entries between award categories. If this occurs the Clear Communication Awards will advise the entrant in writing prior to announcing finalists.
An Award can be attributed to an individual entrant, employer or organisation. Award certificates will only be provided to individuals or organisations listed on the entry from.
By entering the Clear Communication Awards, each entrant acknowledges that their entry is true, accurate, complete and original work, that any intellectual property rights arising in connection with that entry are owned by the entrant and that the entry does not interfere with any third-party rights.
Entries are considered to be accepted at the time we receive them. We will not be held liable for any loss incurred if we do not receive your entry, for any reason, during the entry.
The Clear Communication Awards can decline a submission or disqualify any entry at its absolute discretion.
Privacy and copyright
Judges’ decision is final
Judges have discretion in assessing entries, applying the judging criteria, terms and conditions and determining the recommended results. The decision of the Clear Communications Award is final, and no correspondence or discussion will be entered into in relation to decisions made.
Judge conflicts of interest
No judge will be allowed to participate in the judging of a category if their agency or affiliated businesses have entered the same category, or if there is any other conflict of interest. Judges are expected to declare any potential conflicts of interest and step aside from judging an entry where any conflict may occur.
Failure to meet terms and conditions
If an entrant who is judged a winner is subsequently found to have failed to satisfy or abide by the terms, they will not be entitled to the relevant award. In this case, the Clear Communication Awards may present the relevant award to another entrant or choose not to present the award at all. A refund will not be provided.
To the extent permitted by law, the Clear Communication Awards will not be liable for any loss or damage or personal injury suffered or sustained in connection with the Awards. You will indemnify us and our officers, employees or agents against any loss or liability from any claim or action that arises as a result of a breach of these terms by you, or your use of the materials or information supplied by you under these Terms. You irrevocably and unconditionally consent to all acts being done that would otherwise breach your Moral Rights.
Disqualification and refunds
We reserve the right, at any time, and at our sole discretion to:
- request entrants to provide proof of identity and/or proof of valid entry
- disqualify any entrant who we have reason to believe has breached any of these terms or engaged in any unlawful or other improper conduct or any conduct calculated to jeopardise the fair and proper conduct of the promotion.
Refunds will not be provided in any circumstance.
Marketing and promotion
The Awards are about raising the profile of clear communication in Australia. All entrants must be happy for their entry to be used to promote the Awards and be available for interview if they win. Entrants must be willing to verbally support the Awards. Reasonable notice will be given of any such request.
You agree that we may use your logo, business identity, details about your business or personal identity in any way in any material which promotes the Awards. You agree to allow us to contact you to provide comments about the Awards and to take photos or video footage of you, your business and your representative(s), and use any of the material collected as part of your participation. If we do use any of the materials listed above, you grant us a royalty free, perpetual and irrevocable licence to use the materials for promotional purposes.
All intellectual property rights related to the Awards, including the information and data we collect, belong to us. Entrants own any intellectual property rights already owned before entering the Awards. By entering the Awards, you also assign to the Clear Communication Awards all intellectual property rights, both present and future, that arise in relation to your participation in the Awards.
